Discussion: In February, 1999, the Commission adopted rules to protect the privacy of telecommunications consumers. These rules are codified in WAC 480-120-144, -151, -152, -153, and -154. Due to an administrative oversight, the Commission did not delete an older privacy provision in WAC 480-120-139 when it adopted the new privacy rules. The result is that identical provisions now appear in WAC 480-120-139(5) and WAC 480-120-144. At the same time it adopted new rules, the Commission issued a supplemental notice of proposed rulemaking. The purpose of this rulemaking is to eliminate the duplicate provision by deleting subsection (5) of WAC 480-120-139. The Commission issued a supplemental notice of proposed rulemaking on March 25, 1999. The Commission received no comments in response to the supplemental notice. Conclusion: Staff recommends that the final rule language be adopted by the Commission deleting section (5) of WAC 480-120-139. Staff recommends the Commission adopt the rules as proposed. Attachment
