(AT&T) filed with the Commission a complaint against U S WEST Communications, Inc. (U S WEST). The complaint alleges that U S WEST has failed to provide adequate and consistent quality of access services by (1) failing to provision necessary access facilities; (2) failing to timely provision access facilities it does provide in violation of agreed upon measures of quality, and (3) favoring itself, its affiliates, its own customers and certain communities in deciding where to provision facilities. A more detailed account of the allegations is reflected in the complaint which is available for inspection at the Commission's office, Chandler Plaza Building, 1300 S. Evergreen Park Drive S.W., Olympia, Washington. It is appropriate for this matter to be brought on for hearing before the Commission. Hearing in this matter is being held pursuant to Part IV of chapter 34.05 RCW pertaining to adjudicative proceedings, including but not limited to RCW 34.05.413, RCW 34.05.431, RCW 34.05.440, RCW 34.05.449, RCW 34.05.452, and RCW 80.01.100. The Commission has jurisdiction over this matter under Title 80 RCW, having legal authority to regulate the rates, services, and practices of telecommunications companies providing service within the state of Washington and to hear complaints brought by one public service company against another such company. Statutes and rules cited in the complaint include RCW 80.01.040, RCW 80.04.110, RCW 80.04.380, RCW 80.36.080, RCW 80.36.090, RCW 80.36.140, RCW 80.36.160, RCW 80.36.170, RCW 80.36.186, RCW 80.36.260, RCW 80.36.300, WAC 80-36-300, WAC 480-09-420, WAC 480-120-016, WAC 480-120-022, WAC 480-120-023, WAC 480-120-051, WAC 480-120-101, WAC 480-120-500, and WAC 480-120-535. In addition to the foregoing, statutes and rules involved include those within chapter 80.36 RCW, chapter 480-120 WAC, and chapter 480-09 WAC. The issues involved are generally stated above and more specifically contained in the complaint. Based upon its review of the complaint, the Commission finds that good cause exists for scheduling a prehearing conference on shortened notice. NOTICE IS HEREBY GIVEN That a prehearing conference will be held at 1:30 p.m., on Thursday, September 2, 1999, in the Commission's Hearing Room, Second Floor, Chandler Plaza Building, 1300 S. Evergreen Park Drive S.W., Olympia, Washington. The time and place for evidentiary hearings will be set at the prehearing conference or by later written notice. The purpose of said prehearing conference is to consider formulating the issues in the proceeding and determine other matters to aid in its disposition, as specified in WAC 480-09-460. Petitions to intervene should be made in writing prior to that date or made orally at that time. Appearances will be taken.
