It appearing that the filing herein would increase rates for water service rendered by respondent and that the rights and interest of the public might be injuriously effected thereby, the Commission, on June 6, 1997, entered a Complaint and Order Suspending Contract. The Commission is now in receipt of a letter dated March 13, 1998, by which the new owner of Sound Water assets, Rainier View Water Company, Inc. (Rainier View) respondent, requests that the contract filed in this docket be withdrawn. Rainier View believes that Ms. Will paid Sound Water more than adequate compensation for the fire hydrant and she does not need to pay any remaining amounts due under the previous contract. Rainier View considers the contract to be fully performed and the matter closed. From all indications, it appears to be in the public interest to grant the request and to concurrently dismiss the Complaint and Order Suspending Contract, and close the docket. O R D E R THE COMMISSION THEREFORE ORDERS That the contract, filed in this docket, dated May 14, 1997, shall be and the same withdrawn, and that the Complaint and Order Suspending Contract in this docket dated June 6, 1997, shall be and the same is hereby dismissed, and the docket number referenced herein is closed. DATED at Olympia, Washington, and effective this 8th day of April, 1998. WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION PAUL CURL, Acting Secretary
