UT-970407 Complainant, ) ) vs. ) ) DISMISSING COMPLAINT, TOLEDO TELEPHONE COMPANY, ) LIFTING SUSPENSION AND INCORPORATED ) APPROVING TARIFF ) REVISIONS Respondent. ) . . . . . . . . . . . . . . . ) On February 13, 1998, the Toledo Telephone Company, Inc., filed with the Commission revisions to its currently effective Tariff WN U-1 designated as First Revision of Sheet No. 67. The stated effective date is March 15, 1998. At the Commission’s open public meeting of May 16, 1997, the Commission suspended the filing for investigation to ensure the rights and interests of the public would not be injuriously affected. The Commission staff has completed its investigation into the rates and charges contained in Docket UT-970407. The investigation established that rates and charges filed by the respondent were excessive. At the open public meeting of May 16, 1997, staff recommended that rate levels lower than those filed by the respondent should be allowed to become effective as permanent rates. The respondent has agreed to accept staff recommended rate levels and to file substitute tariff sheets to reflect said levels. Staff recommended level is $7.00 per month for Caller ID service. Pursuant to review of the filing and staff recommendations, the Commission finds that the Complaint and Order Suspending Docket UT-970407 should be dismissed and permanent rates be allowed to become effective at levels recommended by staff. O R D E R 1. The Complaint and Order issued May 16, 1997, suspending Docket UT-970407 is hereby dismissed. 2. Staff recommended rates shall be authorized to become effective March 15, 1998. 3. The respondent shall cause to be filed with the Commission, substitute tariff sheets which accurately reflect the rates and charges herein authorized.
