BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested Waiver of Statutory Notice in Connection with the Contract Filed by PacifiCorp d/b/a Pacific Power & Light. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) ) ) ) ) ) ) DOCKET UE-010686 ORDER GRANTING LESS THAN STATUTORY NOTICE BACKGROUND 1 On May 9, 2001, PacifiCorp, dba Pacific Power & Light Company (PacifiCorp) filed with the Commission, under its Advice No. 01-008, a revision to its currently effective Tariff WN U-74, designated as First Revision of Sheet No. 72.2. 2 WAC 480-80-070 requires thirty days’ notice prior to the effective date of the tariff. The tariff sheet bears an inserted effective date of June 8, 2001. This date recognizes statutory notice as required. The Company requests, however, that statutory notice be waived as authorized in WAC 480-80-240, and that the revisions become effective May 31, 2001. 3 Subsection 6 (b) Facilities on Customer’s Premises, of the General Rules and Regulations that are part of the Company’s current tariff includes the requirement that customers install approved safeguards before connecting an electric generator or other source of electric energy to wiring that is energized at any time from the Company’s system. The safeguards must include a disconnect and transfer switch installation approved by the public authority having jurisdiction. Additionally, subsection 6 (b) allows the Company to disconnect service or to refuse to connect service when the customer’s wiring or facilities are, in the company’s judgment, unsafe or hazardous to the customers or others. Subsection 6(b) of the General Rules and Regulations fully applies to Schedule 72 as well as all other Schedules in PacifiCorp’s tariff. 4 The proposed change to Schedule 72 clarifies the requirement that customers using other pumping energy sources to power their existing electric pumps must install a transfer switch. PacifiCorp requests approval on Less than Statutory Notice due to safety concerns expressed by Company’s employees. In an emergency safety meeting in Hermiston, Oregon, field employees said that the Schedule 72 transfer switch requirement would be clearer if it were listed on Schedule 72 as well as in the General Rules and Regulations. In response to its employees’ concerns, the Company wishes to include the proposed revision in Schedule 72 as soon as possible. 5 Since the tariff revision appears to be fair, just, and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is appropriate that the Commission grant the waiver PacifiCorp requests with an effective date of May 31, 2001. FINDINGS 6 (1) After careful examination of the tariff revision filed by PacifiCorp on May 9, 2001, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the proposed tarifff revision should become effective May 31, 2001. 7 (2) This matter was brought before the Commission at its regularly scheduled open meeting on May 30, 2001. The Commissioners, having been fully advised in the matter, and having determined this order to be consistent with the public interest, directed the Secretary to enter his order. O R D E R 8 THE COMMISSION GRANTS the requested waiver of statutory notice in connection with the tariff revision filed by PacifiCorp, dba Pacific Power & Light Company, on May 9, 2001, and the tariff revision shall become effective May 31, 2001.
