See attached. On December 8, 1999, in Docket No. UT-991931, Barbara Brady filed with the Commission a petition requesting that the exchange area boundaries of GTE Northwest Incorporated be changed to include the community of 29 families on or near SR 97 in Section 13 of Township 28 N, Range 23 E, W.M. See attached. On October 28, 1999, in Docket No. UT-993000, the Commission issued an Order Initiating a Proceeding to Determine If Wilderness Lake, Pend Oreille County, Is a Community or Portion Thereof as Contemplated in 47 U.S.C. § 214(e)(3) And, If So, to Designate a Telecommunications Common Carrier to Serve Wilderness Lake. In as much as the foregoing matters involve related principles of law, it is appropriate that they be consolidated for hearing and determination pursuant to WAC 480-09-610(2). ORDER OF CONSOLIDATION IT IS HEREBY ORDERED that each of the above-entitled cases are consolidated for hearing and determination, with the Commission reserving the right to hold such separate hearings and to issue separate orders in the individual dockets as it may deem appropriate. NOTICE OF PREHEARING CONFERENCE Hearing in this matter is being held pursuant to Part IV of chapter 34.05 RCW pertaining to adjudicative proceedings, including but not limited to RCW 34.05.413, RCW 34.05.431, RCW 34.05.440, RCW 34.05.449, and RCW 34.05.452. The Commission has jurisdiction over this matter under Title 80 RCW, having legal authority to regulate the rates, services, and practices of telecommunications companies providing service within the state of Washington, the power to prescribe exchange area boundaries for telecommunications companies, and the authority to take actions, conduct proceedings, and enter orders as permitted or contemplated for a state commission under the federal Telecommunications Act of 1996. Statutes involved include those within chapter 80.36 RCW, particularly RCW 80.36.230, RCW 80.36.600, and RCW 80.36.610. Rules involved include those within chapters 480-120 WAC and chapter 480-09 WAC. NOTICE IS HEREBY GIVEN that a prehearing conference will be held at 1:30 p.m., on February 4, 2000, in Room 108, Chandler Plaza Building, 1300 S. Evergreen Park Drive S.W., Olympia, Washington. To assist the Commission in its consideration of the petitions, the companies are required to file with the Commission responses to the petitions not later than 3:00 p.m., January 26, 2000. The time and place for evidentiary hearings will be set at the prehearing conference or by later written notice. The purpose of said prehearing conference is to consider formulating the issues in the proceeding and determine other matters to aid in its disposition, as specified in WAC 480-09-460.
