BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of Tariff Revisions ) DOCKETS UW-990642 and and the Requested Waiver of ) UW-991238 Statutory Notice in Connection ) with the Tariff Revisions Filed by ) ORDER DISMISSING Meadows Water System, L.L.C. ) COMPLAINT AND ORDER ) SUSPENDING TARIFF ) REVISIONS AND ) GRANTING LESS THAN . . . . . . . . . . . . . . . . . . ) STATUTORY NOTICE On April 30, 1999, Meadows Water System, L.L.C., (Meadows Water) filed tariff revisions in docket UW-990642 with the Commission designated as: First Revised Sheet No. 1 Canceling Original Sheet No. 1, First Revised Sheet No. 2 Canceling Original Sheet No. 2, First Revised Sheet No. 9 Canceling Original Sheet No. 9 and Second Revised Sheet No. 21 Canceling First Revised Sheet No. 21. Under the revised filing in docket UW-991238 the company has asked for Less Than Statutory treatment of revised Sheets No. 1, 2, 8, 9. 21, and Original Sheet No. 35. The proposed revisions in docket UW-990642 asked for general rates in the amount of $108,586 (49 percent) of additional revenue per year. The company is requesting a rate filing due to increased federal and state regulations regarding water testing and planning requirements. Computer upgrades and software changes for billing have also increased since the last rate filing. The company serves approximately 788 residential customers near Lacey, in north Thurston County. Because the filing in docket UW-990642 would have increased rates for water service rendered by respondent and that the rights and interest of the public might have been injuriously affected thereby, the Commission, May 26, 1999, entered a Complaint and Order Suspending Tariff Revisions. The Commission is now in receipt of a letter dated August 1, 1999, whereby respondent requests that the tariff revisions filed in docket UW-990642 to be withdrawn. From all indications, it appears to be in the public interest to accommodate the request and to dismiss the Complaint and Order Suspending Tariff Revisions in docket UW-990642. Concurrent with the withdraw letter for docket UW-990642, the company filed revised tariff sheets in docket UW-991238. Revised rates and a capital improvement surcharge will produce an increase of $39,053 (17.9 percent). These revised sheets bear an inserted effective date of September 15, 1999. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the revisions become effective September 1, 1999, to coincide with the company's next billing cycle. As part of both filings, the company also asked for several ancillary charge updates and a late payment fee of 1.5 percent. Since the revised tariff revisions filed in docket UW-991238 appear to be fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of September 1, 1999. FINDINGS After review of the tariff revisions filed in docket UW-990642 by Meadows Water System, L.L.C., April 30, 1999, and giving due consideration, the Commission finds that the Complaint and Order Suspending Tariff Revisions in docket UW-990642, dated May 26, 1999, should be dismissed. After careful examination of the tariff revisions filed in docket UW-991238 by Meadows Water System, L.L.C., August 1, 1999, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revisions should become effective September 1, 1999. O R D E R THE COMMISSION THEREFORE ORDERS: 1. The Complaint and Order Suspending Tariff Revisions in docket UW-990642, dated May 26, 1999, be and the same is hereby dismissed. 2. That the requested waiver of statutory notice in connection with the tariff revisions filed in docket UW-991238 by Meadows Water System, L.L.C., August 1, 1999, is hereby granted, and said tariff revisions shall become effective September 1, 1999. 3. Meadows Water System, L.L.C., will forward copies of Surcharge Quarterly Report (as provided) to Commission staff on a quarterly basis beginning with the quarter ending September 30, 1999. Reports will be forwarded within 45 days of the quarter ending. Reporting shall continue until the company is notified by Commission staff letter that the reports are no longer required.
