DOCKET UW-981020 Page 1 BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Contract for Service and ) DOCKET UW-981020 Wavier of WAC 480-110-121 ) Filed by North Bainbridge ) ORDER GRANTING CONTRACT Water Company, Inc. ) AND APPROVAL OF WAIVER ) OF WAC 480-110-121 On July 27, 1998, North Bainbridge Water Company, Inc., (Company) filed in Docket UW-981020 a contract between the Company and Eagle Harbor Properties for construction of a four-inch (4") ductile iron main to provide fire protection service to Eagle Harbor Properties. The contract is for the developer to install a four-inch (4") ductile iron main with four-inch (4") turbine meter, and backflow prevention device, and leak detector/bypass meter connecting developer’s property with the Company’s main through a road crossing under Valley Road. Developer shall pay a fire protection fee of $0.25 per hundred square feet of building space on developer’s property. Additionally developer shall deliver a bill of sale to the Company for all improvements. After the date of acceptance of the extension, the Company shall own and operate the extension. Developer and Company agree that the existing service connection for domestic purposes is adequate to serve the property and is similar to usage by a residential customer. Should the specific businesses demonstrate usage which would substantially exceed residential class usage the developer understands that the usage class may change and require an additional application for water services. The Company used a standard contract, because its tariff does not cover this type of service. Previously, the Company has filed several contracts with the Commission and used its standard form of contract. The water company is requesting waiver of WAC 480-110-121 to coincide with the Company's practices. This regulation can be interpreted as requiring the utility to pay for and own any meter that is installed for delivery of water service. Under the contract the purpose of these meter installations will be to function as leak detection devices and to detect the unauthorized use of water for domestic water use. As such the Company states that these meters are not used to determine the charge to be made for water service, which seems to be the direction or intent of WAC 480-110-121. Since the contract filed herein appears fair, just and reasonable, and waiver of WAC 480-110-121 is not inconsistent with the public interest, it is deemed appropriate that the Company be granted the waiver it is requesting. FINDINGS After careful examination of the contract filed herein by North Bainbridge Water Company, Inc., July 27, 1998, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the contract should be allowed to become effective September 15, 1998. O R D E R THE COMMISSION THEREFORE ORDERS That the Contract for Service is granted and the requested waiver of WAC 480-110-121 is hereby approved, in connection with the contract filed herein by North Bainbridge Water Company, Inc., July 27, 1998, and said contract shall become effective September 15, 1998.
