BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested Waiver of Statutory Notice in Connection with the Tariff Revisions Filed by Puget Sound Energy . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) ) ) ) ) ) ) DOCKET UG-010717 ORDER GRANTING LESS THAN STATUTORY NOTICE BACKGROUND 1 On May 14, 2001, Puget Sound Energy (PSE) filed with the Commission revisions to its currently effective Tariff WN U-2, designated as 121st Revision Sheet No. 101-A and 1st Revision Sheet No. 37-A. The purpose of 121st Revision Sheet No. 101-A is to pass through an increase from 4% to 6% in the municipal tax rate for the City of Sultan. City of Sultan Ordinance 754-00 instituted the increase. The purpose of 1st Revision Sheet No. 37-A is to correct the numbering of the definition in section 2 of Rule 23. 2 WAC 480-80-070 requires thirty days’ notice prior to the effective date of the tariff. The tariff sheet bears an inserted effective date of June 21, 2001. This date recognizes statutory notice as required. However, the Company requests that statutory notice be waived as authorized in WAC 480-80-240, and that the revisions become effective June 1, 2001 since the effective date of the new tax rate is March 1, 2001. 3 Since the proposed tariff revisions appear to be fair, just, and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is appropriate that the Commission grant the waiver PSE requests with an effective date of June 1, 2001. FINDINGS 4 (1) After careful examination of the proposed tariff revisions filed by PSE on May 21, 2001, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the proposed tariff revisions should become effective June 1, 2001. 5 (2) This matter was brought before the Commission at its regularly scheduled open meeting on May 30, 2001. The Commissioners, having been fully advised in the matter, and having determined this order to be consistent with the public interest, directed the Secretary to enter this order. O R D E R 6 THE COMMISSION GRANTS the requested waiver of statutory notice in connection with the tariff revisions filed by PSE on May 21, 2001, and the tariff revisions shall become effective on June 1, 2001. DATED at Olympia, Washington, and effective this 30th day of May, 2001. WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION CAROLE J. WASHBURN, Secretary
