On February 8, 2000, Country Water, Inc., (Country Water) sold all assets and operations of the Country Water System to Valley Water District, located in Pierce County. The Commission has no jurisdiction over Valley Water District or the water services it provides. The former Country Water customers are being charged equal rates, as other district members are, and can vote to become members of the Valley Water District. On February 14, 2000, Country Water filed a letter requesting the Commission cancel their tariff WN-U2 and deregulate the company, as they were dissolving the corporation. As a result of this application, Country Water is determined to no longer provide regulated water service. The Commission can remove a water company from regulation under the provisions of RCW 80.04.010. A water company cannot be removed from regulation except with the approval of the Commission. Removing Country Water from regulation will not be inconsistent with the public interest, because the water system is now operated and owned by the Valley Water District which is not regulated by this Commission. From all indications, it appears to be in the public interest to grant the removal from regulation and cancel the corresponding tariff. O R D E R THE COMMISSION ORDERS: 1. Country Water, Inc., is hereby determined not to be jurisdictional pursuant to the Commission staff investigation and documents filed with the Commission. 2. Country Water, Inc., is removed from regulation by this Commission and its current tariff WN-U2 is canceled as of the effective date of this order.
