UT-000096 ORDER OF CONSOLIDATION AND NOTICE OF PREHEARING CONFERENCE (May 22, 2000) On January 3, 2000, Lights Camera News/Corporate Feud, filed a complaint against U S WEST Communications, Inc. in Docket No. UT-000014. The complaint alleges that the respondent has violated state laws by unlawfully disconnecting complainants telecommunications service, breaching its contract with complainant, and failing to provide prompt, efficient, or adequate service to the complainant. The complainant prays for imposition of sanctions or fines, damages, and refund of various billings from the respondent. On January 18, 2000, Lights Camera News/Corporate Feud, filed a complaint against U S WEST Communications, Inc. in Docket No. UT-000096. The complaint alleges that the respondent has violated state laws by unlawfully disconnecting complainants telecommunications service and failing to provide prompt, efficient, or adequate service to the complainant. The complainant prays for imposition of sanctions or fines, damages, and refund of various billings from the respondent. Respondent filed its answer on February 15, 2000 in Docket No. UT-000096. On March 7, 2000, respondent filed an Answer and Affirmative Defenses of U S WEST Communications, Inc., in which it incorporates a response to both complaints in Docket Nos. UT-000014 and UT-000096. A more detailed account of the disputes are reflected in the foregoing pleadings, which are available for inspection at the Commission's office, Chandler Plaza Building, 1300 S. Evergreen Park Drive S.W., Olympia, Washington. It is appropriate that the matters raised in the pleadings be brought to a hearing before the Commission. In as much as the foregoing matters involve common questions of fact and law, they should be consolidated for hearing and determination, pursuant to WAC 480-09-610(2). ORDER OF CONSOLIDATION IT IS HEREBY ORDERED That the above-entitled matters are consolidated for hearing and determination, with the Commission reserving the right to hold such separate hearings and to issue separate orders in the individual dockets as it may deem appropriate. NOTICE OF PREHEARING CONFERENCE The prehearing conference in these consolidated dockets is being held pursuant to Part IV of chapter 34.05 RCW pertaining to adjudicative proceedings, including but not limited to RCW 34.05.413, RCW 34.05.431, RCW 34.05.440, RCW 34.05.449, and RCW 34.05.452. The Commission has jurisdiction over these matters pursuant to Title 80 RCW under which it regulates the rates, services, and practices of telecommunications companies providing service within the state of Washington. Statutes and rules cited by the respective parties include RCW 80.04.440, RCW 80.36.130, WAC 480-120-081, WAC 480-120-101, WAC 480-120-106, WAC 480-120-136, WAC 480-120-500, and WAC 480-120-520. In addition to the foregoing, statutes and rules involved include those within chapters 80.36 and 80.04 RCW, and chapter 480-120 WAC relating to the charges and practices of telecommunications companies, and chapter 480-09 WAC relating to practice and procedure, including WAC 480-09-480 relating to obtaining data in adjudicative hearings. The issues involved are generally stated above and more specifically contained in the pleadings herein.
