BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of ) Joint Application for ) Sale and Transfer of ) DOCKET UW-990953 Canterwood Water Company, Inc., to ) Harbor Water Company, Inc. ) ORDER DISMISSING THE ) JOINT APPLICATION FOR ) SALE AND TRANSFER AND ) CLOSING DOCKET . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) BACKGROUND On July 7, 1999, Canterwood Water Company, Inc., and Harbor Water Company, Inc., filed a Joint Application for Sale and Transfer of the Canterwood Water Company, Inc., under the provisions of chapter 80.12 RCW and chapter 480-143 WAC. On July 19, 1999, the Commission received a letter in opposition to the sale and transfer. This letter was accompanied by copies of legal proceedings against Canterwood Water Company, Inc. In accordance with the contract provisions paragraph 11, closing date indicates that if the closing has not occurred by December 31, 1999, that the agreement shall terminate unless extended. Commission Staff has requested additional information from both parties on December 7, 1999, and January 11, 2000. Neither party has responded or indicated any kind of an extension. As a result of this investigation and the expiration of the contract terms, Commission staff is requesting closing the docket in the Matter of the Joint Application for Sale and Transfer. Dismissing the application and closing the docket would not be inconsistent with the public interest, as the water system would remain under Commission’s jurisdiction and regulation. FINDINGS From all indications, it appears to be in the public interest to dismiss Docket UW-990953 in the Matter of Joint Application for Sale and Transfer of the Canterwood Water Company between Canterwood Water Company, Inc., and Harbor Water Company, Inc. O R D E R THE COMMISSION ORDERS: 1. Canterwood Water Company, Inc., is hereby determined to be jurisdictional pursuant to the Commission Staff investigation and documents filed with the Commission. 2. The Joint Application for sale and Transfer of the Canterwood Water System between Canterwood Water Company, Inc., and Harbor Water Company, Inc., is hereby dismissed and its current tariff, WN U-1, remains effective under the name of Canterwood Water Company, Inc. 3.
