BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested Waiver of Statutory Notice in Connection with the Tariff Revisions Filed by Avista Corporation . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) ) ) ) ) ) ) DOCKET UE-010839 ORDER GRANTING LESS THAN STATUTORY NOTICE BACKGROUND 1 On June 7, 2001, Avista Corporation (Avista) filed with the Commission revisions to its currently effective Tariff WN U-28, designated as First Revision Sheet 92 canceling Original Sheet 92 and Original Sheet 92A. The purpose of the filing is to 1) add qualifying language to an existing condition and 2) add a new condition to the Special Terms and Conditions Section of 92 – All Customer Electric Energy Buy-Back Program. 2 The proposed changes address situations that have arisen where customers usage has been reduced at the meter for reasons other than those intended by the program. The language addition to the existing condition gives Avista some flexibility to evaluate, on a situation by situation basis, customers with multiple meters who reduce usage at one meter but not necessarily in total. The new condition eliminates the credit to commercial and industrial customers who have discontinued operations, unrelated to conservation. 3 WAC 480-80-070 requires thirty days’ notice prior to the effective date of the tariff. The tariff sheet bears an inserted effective date of July 9, 2001. This date recognizes statutory notice as required. However, the Company requests that statutory notice be waived as authorized in WAC 480-80-240, and that the revisions become effective June 14, 2001. The request for the LSN is to coincide the revised conditions with the start of the next billing period which begins June 14. 4 Since the proposed tariff revisions appear to be fair, just, and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is appropriate that the Commission grant the waiver Avista requests with an effective date of June 14, 2001. FINDINGS 5 (1) After careful examination of the proposed tariff revisions filed by Avista on June 6, 2001, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the proposed tariff revisions should become effective June 14, 2001. 6 (2) This matter was brought before the Commission at its regularly scheduled open meeting on June 13, 2001. The Commissioners, having been fully advised in the matter, and having determined this order to be consistent with the public interest, directed the Secretary to enter this order. O R D E R 7 THE COMMISSION GRANTS the requested waiver of statutory notice in connection with the tariff revisions filed by Avista on June 6, 2001, and the tariff revisions shall become effective on June 14, 2001.
