UE–010826 ORDER GRANTING LESS THAN STATUTORY NOTICE BACKGROUND 1 On June 5, 2001, PacifiCorp dba Pacific Power & Light Company (PacifiCorp) filed with the Commission under its Advice No. 01-011, revisions to its currently effective Tariff WN U-74, designated as Second Revision to Sheet No. 115.1, First Revision to Sheet Nos. 115.2, 115.3, 115.4, 115.5, Original Sheet Nos. 115.6, 115.7, 115.8, First Revision of Sheet Nos. 116.1, 116.2, 116.3, 116.4, Original Sheet Nos. 116.5, 116.6, 116.7, 116.8, Third Revision of Sheet No. 125.1, Second Revision of Sheet Nos. 125.2, 125.3, 125.4, 125.5, 125.6. The following tariff pages are to be deleted: First Revision of Sheet Nos. 125.7, 125.8, 125.9, Original Sheet No. 125.10. 2 The tariff sheets bears an inserted effective date of July 6, 2001. This date recognizes statutory notice as required. The Company requests, however, that statutory notice be waived and that the revision become effective June 28, 2001. PacifiCorp requests approval with less than statutory notice in order to enable customers to adopt energy saving measures on an expedited basis as a response to the current energy situation and Governor Locke’s call for conservation. 3 The proposed revisions make the following changes to the Company’s energy efficiency programs for commercial and industrial customers in Schedules 115, 116 and 125: · Adds new measures to the incentive tables in Schedules 115 and 116, · Adds a Short Term Incentive in Schedules 115, 116 and 125 for projects completed by December 31, 2001, · Adds an incentive in Schedule 125 for demand reduction during on-peak hours, · Removes the loan option in Schedule 125, and · Makes several administrative changes in Schedules 115, 116 and 125. 4 Since the tariff revision filed herein is fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the Company be granted the waiver it is requesting with an effective date of June 28, 2001. FINDINGS 5 (1) After careful examination of the proposed tariff revisions filed by PacifiCorp on June 5, 2001, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the proposed tariff revisions should become effective June 28, 2001. 6 (2) This matter was brought before the Commission at its regularly scheduled open meeting on June 27, 2001. The Commissioners, having been fully advised in the matter, and having determined this order to be consistent with the public interest, directed the Secretary to enter this order. O R D E R 7 THE COMMISSION THEREFORE ORDERS That the requested waiver of statutory notice in connection with the tariff revision filed herein by PacifiCorp dba Pacific Power and Light Company, June 5, 2001, is hereby granted, and said tariff revision shall become effective June 28, 2001.
