BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of a Petition Seeking Exemption to Rules Relating to Filing of Annual Reports and Definitions of Classes of Solid Waste Companies, by ADA-LIN WASTE SYSTEMS, INC., G-104 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) DOCKET TG-010635 ) ) ORDER GRANTING ) EXEMPTION AND ) ALLOWING COMPANY ) TO FILE "CLASS C" ) ANNUAL REPORT ) BACKGROUND 1 On April 27, 2001, the Commission received a petition from Ada-Lin Waste Systems, Inc., (Ada-Lin) requesting the Commission grant an exemption to rules in Chapter 480-70 WAC relating to filing of annual reports and defining classes of solid waste collection companies. The petition requests Ada-Lin be granted authority by the Commission to file a Class C annual report rather than a Class B annual report. The petition states that Ada-Lin finds the Class B report too burdensome and costly to prepare for a company of their size. 2 Definitions of classes of solid waste collection companies are contained in WAC 480-70-041. A "Class B Company" is defined as a traditional solid waste collection company with annual gross operating revenue from regulated, intrastate operations of less than five million dollars. A "Class C Company" is defined as a solid waste collection company that does not provide traditional residential or commercial solid waste operations. The class includes specialized carriers generally hauling specific waste products for specific customers or providing only on-call or nonscheduled service. 3 Annual reports for Class C companies are substantially less detailed than those filed by Class B companies, requiring less time and effort to complete. Ada-Lin is a small company, serving less than 650 customers, with annual revenues of less than $250,000. The Commission has granted Ada-Lin authority each year since 1987 to file the less complicated Class C annual report. FINDINGS 4 The Commissioners have reviewed the petition and have been fully advised in the matter. They believe granting the petition is not inconsistent with public interest, and direct the Secretary to issue the Order. O R D E R 5 THE COMMISSION ORDERS: 6 Ada-Lin Waste Systems, Inc., is granted an exemption provisions of Chapter 480-70 WAC related to filing of annual reports and definitions of classes of solid waste collection companies and is hereby authorized to file a Class C Annual Report in Lieu of filing a Class B Annual Report.
