BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested Waiver of Statutory Notice in Connection with the Contract Filed by Qwest Corporation . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) ) ) ) ) ) ) DOCKET UT-010483 ORDER GRANTING LESS THAN REQUIRED NOTICE BACKGROUND 1 On April 10, 2001, Qwest Corporation (Qwest) filed a contract with the Commission. The twelve (12) month Special Contract for Centrex Prime Service provides intrastate, intraLATA telecommunications service including transport, intercommunications, service features and Local Exchange Network Access. The contract will provide the customer service in the Seatac area. 2 WAC 480-80-070 requires thirty days’ notice prior to the effective date of the contract. The contract bears an inserted effective date of May 10, 2001. This date recognizes notice as required. The Company requests, however, that required notice be waived as authorized in WAC 480-80-240, and that the contract become effective April 26, 2001. The company requests less than required notice on behalf of a customer that is anxious to get service installed. 3 Since the proposed contract appears to be fair, just, and reasonable, and waiver of required notice is not inconsistent with the public interest, it is appropriate that the Commission grant the waiver Qwest requests with an effective date of April 26, 2001. FINDINGS 4 (1) After careful examination of the proposed contract filed by Qwest on April 10, 2001, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the proposed contract should become effective April 26, 2001. 5 (2) This matter was brought before the Commission at its regularly scheduled open meeting on April 25, 2001. The Commissioners, having been fully advised in the matter, and having determined this order to be consistent with the public interest, directed the Secretary to enter this order. O R D E R 6 THE COMMISSION GRANTS the requested waiver of required notice in connection with the contract filed by Qwest on April 10, 2001, and the contract shall become effective April 26, 2001.
