Background: A C S TEL COM, INC. (A C S) is registered as a telecommunications company to offer resold direct dialed long distance and debit card services to the public. Under the provisions of WAC 480-121-060, the Commission may revoke a registration for good cause. A C S has failed to: (1) File 3rd and 4th quarter 1999 debit card reports; (2) Maintain a performance bond; and (3) Submit a 1998 annual report and pay regulatory fees. Discussion: A C S is required to maintain a performance bond sufficient to cover outstanding debit cards. On January 18, 2000, Reliance Insurance company submitted a notice canceling A C S’s indemnity bond effective February 13, 2000. Due to A C S’s failure to file debit card reports the Commission is not able to determine if adequate protections are in place to cover outstanding debit cards in the event A C S defaults. As of mid-September 1999, A C S informed staff by telephone that they were not doing business in Washington State. The Commission has not received any complaints on A C S. Staff recommends that the Commission issue a Complaint and Notice of Brief Adjudication to determine whether the Commission should revoke A C S’s registration as a telecommunications company.
