UE-960612 SECOND SUPPLEMENTAL ORDER GRANTING AMENDMENT TO SPECIAL CONTRACT ON LESS THAN STATUTORY NOTICE. BACKGROUND On May 6, 1996, Puget Sound Energy (then Puget Sound Power & Light Company) ("Puget or PSE") filed with the Commission a Power Sales Agreement with Georgia-Pacific West Inc. ("Georgia Pacific or GP"). On June 7, 1996, the Commission approved the Power Sales Agreement as filed. On June 28, 2000, PSE filed an amendment revising Section I (" DEFINITIONS") of Schedule RTP to the Power Sales Agreement negotiated and approved by both parties to the contract. Specifically, the amendment changes the definition of the index to be used for energy pricing to the Dow Jones Mid-Columbia Electricity Index reporting "Firm On-Peak," "Firm Off- Peak," and "Sunday & NERC Holidays 24 Hour Firm" energy prices (in dollars per megawatt- hour). In a revised advice letter, dated July 7, 2000, Puget asked for an effective date of July 13, 2000, which is Less than Statutory Notice. Puget states that good cause is shown for approving the request based on the understanding that both PSE and GP agree that the revision as outlined in the amendment is appropriate and no other customers are adversely impacted by this change. By letter dated July 11, 2000, GP has indicated its support for the amendment. The several conditions imposed by the Commission in its original order dated June 7, 1996 should remain in effect for the duration of the special contract. These conditions addressed the topics of precedence with regard to pricing, cost shifting from special contract customers to general ratepayers, reporting to the Commission during the term of the contract, and PSE's future obligation to serve following expiration of the contract. FINDINGS OF FACT 1. Puget Sound Energy, Inc., is engaged in the business of furnishing electric and gas service within the state of Washington as a public service company, and is subject to the jurisdiction of this Commission. 2. After reviewing PSE’s July 7, 2000, revised filing, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the Company’s Power Sales Agreement Amendment with Georgia-Pacific is in the public interest and should become effective on July 13, 2000. 3. The conditions ordered by the Commission in its June 7, 1996 order in Docket No. UE-960612 should remain in effect for the duration of the special contract. ORDER THE COMMISSION ORDERS that Puget Sound Energy’s July 7, 2000, requested waiver of statutory notice regarding the Power Sales Agreement Amendment with Georgia-Pacific is granted subject to the original conditions contained in Commission’s June 7, 1996 order and such revisions shall become effective on July 13, 2000.
