DOCKET UE-990213 Page 1 BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UE-990213 Connection with the Tariff ) Revision Filed by ) ORDER GRANTING LESS Pacific Power and Light Company. ) THAN STATUTORY NOTICE ) On February 23, 1999, Pacific Power and Light Company filed with the Commission under its Advice No. 99-002 a revision to its currently effective Tariff WN U-74, designated as Eighth Revision of Sheet No. 101.1. The tariff sheet bears an inserted effective date of March 25, 1999. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the revision become effective March 5, 1999. The purpose of the filing is to change the City of Pomeroy tax rate to comply with Pomeroy Ordinance No. 758 effective March 1, 1999. The tax rate changes from 5% to 6% of charges per customer per month. In order for the effective date of the tariff to be as close to the effective date of the ordinance as possible, the Company is requesting that the Commission waive the 30-day statutory notice period making the tariff effective on March 5, 1999. Since the tariff revision filed herein is fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of March 5, 1999. FINDINGS After careful examination of the tariff revision filed herein by Pacific Power and Light Company, February 23, 1999, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revision should become effective March 5, 1999. O R D E R THE COMMISSION THEREFORE ORDERS That the requested waiver of statutory notice in connection with the tariff revision filed herein by Pacific Power and Light Company, February 23, 1999, is hereby granted, and said tariff revision shall become effective March 5, 1999. DATED at Olympia, Washington, and effective this 26th day of February, 1999. WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION CAROLE J. WASHBURN, Secretary
