Carlene Hughes, Program Coordinator Bonnie Allen, Program Coordinator Heather Laughlin, Utilities Rate Research Specialist Diana Otto, Consumer Affairs Supervisor Penny Hansen, Public Involvement Coordinator Jennifer Watsek, Rules Coordinator Tim Sweeney, Public Affairs Recommendation: Direct the Secretary to file a preproposal statement of inquiry (CR-101) in Docket TG-990161 to initiate a review of the Commission’s rules in Chapter 480-70 of the Washington Administrative Code concerning Solid Waste and/or Refuse Collection Companies. Discussion: The objective of this rulemaking is to review rules governing the Commission’ s regulation of solid waste and/or refuse collection companies in compliance with Executive Order 97-02 to determine whether: 1. The rules comply with authorizing statutes; 2. The current rules are obsolete, duplicative, or need to be repealed; 3. The rules provide the results that they were originally intended to achieve; and 4. The rules are written and organized in a clear and concise manner, in order that they may be readily understood by those to whom they apply. Staff will schedule public meetings and workshops with broad notice to interested persons, inviting regulated carriers, their customers, and other interested parties to participate in the rulemaking process. Staff will make every attempt to include interested persons for each of the solid waste stream elements, including: municipal solid waste; curbside recycling; yardwaste; construction, demolition and land clearing debris; specialty wastes (examples: leachate and waste oil); and medical/biohazardous waste. The staff recommends the Secretary be directed to file a preproposal statement of inquiry (CR-101) in Docket TG-990161 to initiate a review of the Commission’ s rules in Chapter 480-70 of the Washington Administrative Code concerning Solid Waste and/or Refuse Collection Companies.
