BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested Waiver of Statutory Notice in Connection with the Tariff Revisions Filed by Cascade Natural Gas Corporation. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) ) ) ) ) ) ) DOCKET UG-010085 ORDER GRANTING LESS THAN STATUTORY NOTICE BACKGROUND 1 On January 22, 2001, Cascade Natural Gas Corporation, (CNG) filed with the Commission under its Advice No. W01-01-01 revisions to its currently effective Tariff WN U-3, designated as Thirty-Third Revised Sheet No. 500-A, Municipal Tax Additions. 2 The tariff sheet bears an inserted effective date of February 21, 2001. This date recognizes statutory notice as required. The Company requests, however, that statutory notice be waived and that the revisions become effective February 1, 2001. 3 The proposed revision implements an increase in the municipal tax for the City of Othello to 6% from 3%, for the period ending December 31, 2001. Ordinance No. 1040 passed by the City of Othello on September 27, 1999, instituted this tax increase to be effective January 1, 2001. 4 CNG wishes to implement the increase as soon as possible to bring their tariff rate up to the level of the tax currently being imposed by the City of Othello. The change in ordinance rate had been noticed to CNG, however, CNG’s rate section was unaware of the change until after the effective date of the tax rate. 5 Since the tariff revision filed herein is fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that CNG be granted the waiver it is requesting with an effective date of February 1, 2001. FINDINGS 6 After careful examination of the tariff revision filed herein by Cascade Natural Gas Corporation, January 22, 2001, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revision should become effective February 1, 2001. This matter was brought before the Commission at its regularly scheduled open meeting on January 31, 2001. The Commissioners, having been fully advised in the matter, and having determined the following order to be consistent with the public interest, direct the Secretary to enter the following order and related provisions. O R D E R 7 THE COMMISSION THEREFORE ORDERS That the requested waiver of statutory notice in connection with the tariff revisions filed herein by Cascade Natural Gas Corporation, January 22, 2001, is hereby granted, and said tariff revision shall become effective February 1, 2001.
