BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UW-001568 Connection with the Contract Filed by ) ORDER GRANTING LESS South Bainbridge Water Company, Inc. ) THAN STATUTORY NOTICE ) AND APPROVING CONTRACT BACKGROUND On October 17, 2000, South Bainbridge Water Company, Inc., (South Bainbridge) filed a line extension contract and request for less than statutory notice (LSN) treatment. This line extension contract is with Frank R. Kitchell who needs a water availability letter from the utility company to meet minimum code requirements necessary to obtain building permits. This line extension contract calls for replacing and relocates of a water distribution main. The full cost of this relocation will be paid by the customer and will include South Bainbridge's engineering inspection cost before final acceptance. The line extension contract bears an inserted effective date of November 17, 2000. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the contract become effective October 26, 2000. South Bainbridge is requesting LSN treatment of this contract to comply with the request of the customer, building permits and construction season. Since the contract filed herein is fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of October 26, 2000. This matter was brought before the Commission at its regularly scheduled open meeting on October 25, 2000. The Commissioners, having been fully advised in the matter, and having determined the following order to be consistent with the public interest, directed the Secretary to enter the following order and related provisions. O R D E R THE COMMISSION ORDERS: 1. That the requested waiver of statutory notice in connection with the line extension contract filed herein by South Bainbridge Water Company, Inc., October 17, 2000, is hereby granted, and said line extension contract shall become effective October 26, 2000. 2. This order shall in no way affect the authority of this Commission over rates, service, or accounts, evaluations, estimates, or determination of cost or any matters whatsoever that may come before it, nor shall anything herein be construed as an acquiescence in any estimate or determination of cost or any valuation of property claimed or asserted.
