This WAC states that water purveyors providing water service to tenants as part of the business of renting or leasing do not fall under Commission jurisdiction. On September 26, 2000, Cascade Mobile Home Community Water System filed an application to be deregulated and its tariff canceled. Cascade Mobile Home Community Water System provides water to its customers at the same rate billed by the City of Spokane. There is no administrative fee or any other mark-up. Cascade Mobile Home Community Water System only serves water to its tenants within the mobile home community park. As a result of these applications, Cascade Mobile Home Community Water System is determined to no longer provide regulated water service. The Commission can remove a water company from regulation under the provisions of RCW 80.04.010. A water company cannot be removed from regulation except with the approval of the Commission. Removing this company from regulation will not be inconsistent with the public interest, as the water system rates are established by the City of Spokane and a direct pass through by the mobile home park. From all indications, it appears to be in the public interest to grant the removal from regulation and cancel the corresponding tariffs. This matter was brought before the Commission at its regularly scheduled open meeting on October 25, 2000. The Commissioners, having been fully advised in the matter, and having determined the following order to be consistent with the public interest, directed the Secretary to enter the following order and related provisions. O R D E R THE COMMISSION ORDERS: 1. Cascade Mobile Home Community Water System is hereby determined not to be jurisdictional pursuant to the Commission Staff investigation and documents filed with the Commission. 2. Cascade Mobile Home Community Water System is removed from regulation by this Commission and its current tariff is canceled as of the effective date of this order.
