BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UT-001379 Connection with the Tariff ) Revisions Filed by ) ORDER GRANTING LESS Qwest Corporation ) THAN STATUTORY NOTICE ) . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) On September 8, 2000, Qwest Corporation filed with the Commission under its Advice No. 3170T, revisions to its Tariff WN U-40, designated as: Section 5, 1st Revised Sheet 48.1 The tariff sheet bears an inserted effective date of October 9, 2000. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the revisions become effective September 14, 2000. The purpose of this filing is to implement FCC Order No. 00-332. The order requires rate reductions for Lifeline eligible persons residing on Tribal Reservations. The FCC order stayed a portion of an earlier Order and reduced the scope of the enhanced Lifeline program. This tariff makes revisions that reflect the narrower application of the enhanced Lifeline program. The reason for requesting less than statutory notice is to comply with FCC requirements issued in FCC Order No. 00-332. Because the tariff revision filed herein are fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the Company be granted the waiver it is requesting with an effective date of September 14, 2000. FINDINGS After careful examination of the tariff revision filed herein by Qwest Corporation on September 8, 2000, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revision should become effective September 14, 2000. O R D E R THE COMMISSION THEREFORE ORDERS That the requested waiver of statutory notice in connection with the tariff revisions filed herein by Qwest Corporation on September 8, 2000, is hereby granted, and said tariff revisions shall become effective September 14, 2000, and directs the Executive Secretary to enter the appropriate Order.
