BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UT-001004 Connection with the Tariff ) Revision to Tariff WN U-2 Filed ) ORDER GRANTING LESS by United Telephone Company of the Northwest ) THAN STATUTORY NOTICE . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) On June 29, 2000, United Telephone Company of the Northwest (United) filed with the Commission under its Advice No. 326, a revision to its currently effective Tariff WN U-2, designated as 10th Revised Sheet 1 in Schedule AE-9. The revision reflects a change to waive billing the Federal Universal Service Fund End User Charge to Lifeline customers. The tariff sheet bears an inserted effective date of July 31, 2000. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the revision become effective July 13, 2000. United is requesting less than statutory notice for this filing in order to comply with the following FCC orders: Sixth Report and Order in CC Docket Nos. 96-262 and 94-1, Report and Order in CC Docket No. 99-249, Eleventh Report and Order in CC Docket No. 96-45; In the Matter of Access Charge Reform, Price Cap Performance Review for Local Exchange Carriers, Low-Volume Long Distance Users, and Federal-State Joint Board on Universal Service (FCC 00-193), released May 31, 2000 (collectively CALLS Order). Since the tariff revision filed herein is fair, just and reasonable, and waiver of statutory notice is consistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of July 13, 2000. This matter was brought before the Commission at its July 12, 2000, regularly scheduled open meeting. The Commissioners, having been fully advised in the matter, and having determined the following order to be consistent with the public interest, directed the Secretary to enter the following order and related provisions. FINDINGS After careful examination of the tariff revision filed herein by United Telephone Company of the Northwest on June 29, 2000, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revision should become effective on July 13, 2000. O R D E R THE COMMISSION THEREFORE ORDERS That the requested waiver of statutory notice in connection with the tariff revision filed herein by United Telephone Company of the Northwest on June 29, 2000, is hereby granted, and said tariff revision shall become effective on July 13, 2000.
