UE-991896 ORDER APPROVING TARIFF MODIFICATIONS ON LESS THAN THIRTY-DAY NOTICE On December 3, 1999, PSE filed a proposed revision to Sheet No. 150-b - Net Metering Services for Renewable Energy Systems reflecting one change. Under the proposal, customer-generators will no longer be required to maintain commercial general liability insurance, but instead will be required to maintain applicable liability insurance. In addition to the proposed change on Sheet No. 150-b, PSE also proposes to revise the attachment to Schedule 150, the Net Metering Agreement. The proposed revisions include the deletion of Section 13.5 and the addition of one sentence to Section 13.4. This revision was prompted by the fact that some potential customer-generators are having difficulty obtaining insurance that would meet the requirements of this section. Specifically, the requirement that PSE be named as an additional insured on the customer-generator’s insurance policy or that the policy include a waiver of the insurer’s rights of subrogation against the Company has made obtaining insurance extremely difficult for some customers. The filed Revised Sheets denote an effective date of January 3, 2000, for the proposed revision. PSE requests that statutory notice be waived and the Commission issue an order approving the revised schedule to become effective on December 23, 1999, as there are certain customers who may benefit from these changes if the tariff revisions are effective prior to December 31, 1999. PSE indicates that an Olympia-based organization (Climate Solutions) is providing access to federal grant money to Olympia homeowners (through its Solar Pioneers project) for residential photovoltaic systems installed and operational by the end of calendar year 1999. Because of the positive impact this tariff revision will have on customers if it becomes effective before the end of 1999, PSE’s request for waiver of statutory notice is not inconsistent with the public interest. Therefore the Commission should grant the requested waiver and allow the tariff revisions to become effective on December 23, 1999. Docket UE-991896 Page 2 FINDINGS OF FACT 1. Puget Sound Energy, Inc., is engaged in the business of furnishing electric and gas service within the state of Washington as a public service company, and is subject to the jurisdiction of this Commission. 2. After reviewing PSE’s December 3, 1999, filing, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the Company’s Schedule 150 revisions are in the public interest and should become effective on December 23, 1999. ORDER THE COMMISSION ORDERS that Puget Sound Energy’s December 3, 1999, requested waiver of statutory notice regarding Schedule 150 revisions is granted and such revisions shall become effective on December 23, 1999.
