(North Bainbridge Water Co.) filed a water service contract with the Commission and requested less than statutory notice (LSN) treatment. This water service contract is with Brackenwood Lane Water Association (BLWA), a homeowners association. The association represents 23 home and land owners that desire water service from North Bainbridge Water Co. This water service contract calls for the installation of an eight-inch main from the intersection of NE Brackenwood Lane with Sunrise Drive to the North Bainbridge Water Co.'s existing transmission main at the intersection of Knight Road and Sunrise Drive. In addition, BLWA will install eight-inch transmission mains within the Brackenwood Lane Community. Both main lines will be transferred to North Bainbridge Water Co. under the terms of this agreement. The contract also calls for BLWA to transfer to North Bainbridge Water Co. the existing service connections and meters located in the community. BLWA will repair or replace any service connection that does not meet standards. Current residents and property owners of the Brackenwood Lane Community will be new applicants for water service, as of the date the system is transferred and accepted by North Bainbridge Water Co. The contract is currently effective November 5, 1999. This date recognizes statutory notice period as required absent any waiver. The company requests, however, that statutory notice be waived and that the contract become effective October 13, 1999. North Bainbridge Water Co. is requesting LSN treatment of this contract to allow compliance with the related permits and also to recognize the constraints of the remaining construction season. Construction of these improvements is conditioned on suitable weather conditions, so time is of the essence. FINDINGS AND CONCLUSIONS The contract is consistent with the public interest, and waiver of statutory notice is fully justified under the circumstances described. It is appropriate that the company be granted the waiver it requests and the contract be approved with an effective date of October 13, 1999. After careful examination of the contract filed by North Bainbridge Water Company, Inc., on October 6, 1999, and giving consideration to all relevant matters, the Commission finds for good cause shown that the contract should be approved to become effective October 13, 1999. ORDER THE COMMISSION ORDERS That the requested waiver of statutory notice in connection with the contract filed by North Bainbridge Water Company, Inc., October 6, 1999, is hereby granted, and the contract shall become effective October 13, 1999.
