BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested Waiver of Statutory Notice in Connection with the Contract Filed By North Bainbridge Water Company, Inc. . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) ) ) ) ) DOCKET UW-991428 ORDER GRANTING LESS THAN STATUTORY NOTICE AND APPROVING CONTRACT On September 15, 1999, North Bainbridge Water Company, Inc., (North Bainbridge) filed a line extension contract and request for less than statutory notice (LSN) treatment. This line extension contract is with the members of the Day Road Light Manufacturing Fire Flow Association (Day Road Association). The Day Road Association is made up of approximately 18 businesses and/or individuals who are located in the area generally known as the Day Road Light Manufacturing Area and Manzanita Business Park Master Plan Development and who need fire flow capacity to meet minimum code requirements necessary to obtain building permits. This line extension contract calls for the installation of a ten-inch (10") water main from the company’s Madison Avenue storage facility to Day Road West area. The contract project will be completed in three (3) phases with three separate costs. The total projected cost of this project is $524,309. North Bainbridge shall contribute approximately $179,300 toward the project. The remaining amount of $345,009 will be contributed by the Day Road Association. Any cost overruns will be prorated to North Bainbridge and the Day Road Association according to the original allocation percentages. North Bainbridge will enter into separate contracts for main connection costs and fire flow service at the time of connection to the fire flow main. The proposed fire flow rate will be $.25 per one hundred square feet of building space on the entity’s property. Day Road Association will be entitled to a late-comers agreement to future connections outside of the Day Road Association. Late-comer amounts collected will be distributed to the Day Road Association based on original allocation percentages. The line extension contract bears an inserted effective date of October 15, 1999. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the contract become effective September 30, 1999. North Bainbridge is requesting LSN treatment of this contract to comply with building permits and construction season. Since the contract filed herein is fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of September 30, 1999. FINDINGS After careful examination of the line extension contract filed herein by North Bainbridge Water Company, Inc., September 15, 1999, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revision should become effective September 30, 1999. O R D E R THE COMMISSION ORDERS: 1. That the requested waiver of statutory notice in connection with the line extension contract filed herein by North Bainbridge Water Company, Inc., September 15, 1999, is hereby granted, and said line extension contract shall become effective September 30, 1999. 2. This order shall in no way affect the authority of this Commission over rates, service, or accounts, evaluations, estimates, or determination of cost or any matters whatsoever that may come before it, nor shall anything herein be construed as an acquiescence in any estimate or determination of cost or any valuation of property claimed or asserted.
