BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Required Notice in ) DOCKET UT-991361 Connection with the Tariff ) ORDER APPROVING Revision Filed by ) CONTRACT ON LESS U S WEST Communications, Inc. ) THAN 30-DAY NOTICE ) On August 31, 1999, U S WEST Communications, Inc., filed a contract with the Commission. The contract is for synchronous service transport (OC3) intrastate service, which is a point-to-point transport service with a capacity of 155.52 megabits per second. It has a term of sixty months. The monthly recurring charge is $2,490. The contract bears an inserted effective date of September 19, 1999. This date does not provide the thirty-day notice period required under WAC 480-80-330. The company requests, however, that required notice be waived and that the contract become effective September 10, 1999. U S WEST is offering this service through a special contract because it is a specialized service that is not offered under tariff. The Company has submitted a statement that the prices charged under this contract are consistent with prices charged other OC-3 customers and cover the cost of the service. This contract replaces an existing contract that expires on September 18, 1999. The customer signed the contract on August 25, 1999, and U S WEST submitted it to the Commission as soon thereafter as reasonably practical. Since the contract filed herein is fair, just, reasonable, and sufficient, and waiver of required notice is not inconsistent with the public interest, in view of the above, it is deemed appropriate that the company be granted the waiver it is requesting and an effective date of September 10, 1999. FINDINGS After careful examination of the contract filed herein by U S WEST Communications, Inc., on August 31, 1999, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the contract should become effective September 10, 1999. O R D E R THE COMMISSION THEREFORE ORDERS That the requested waiver of required notice in connection with the contract filed herein by U S WEST Communications, Inc., on August 31, 1999, is hereby granted, and said contract shall become effective September 10, 1999.
