On July 14, 1999, American Water Resources, Inc., (American Water) filed with the Commission a contract dated June 23, 1999, for line extension, fire flow, and water service. This contract for line extension is between the utility and South Sound Steel and Recycling, Inc. This contract provides for the developer to install the line extension and deed over the extension to the utility on the water system known as #350 Lathrop. This line extension will be used for providing a single 1 inch water service connection and fire flow at 711 B Airdustrial Way, Tumwater. The developer will pay $1,750 for availablity of fire flow and related system impact. Additionally, the developer will pay a $1,860 facilities charge and a $598.50 service connection charge. American Water will own and operate the line extension and provide water services and fire flow at its currently tariffed rates. American Water is seeking Less Than Statutory Notice (LSN) treatment in an attempt to meet the property owner’s urgent need for water service. The contract bears an effective date of August 13, 1999. This date recognizes statutory notice as required. The utility requests, however, that statutory notice be waived and that the contract become effective July 29, 1999, on less than statutory notice (LSN). Since the contract filed herein appears fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the utility be granted the waiver it is requesting with an effective date of July 29, 1999. FINDINGS After careful examination of the contract filed herein by American Water Resources, Inc., July 14, 1999, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the contract should become effective July 29, 1999. O R D E R THE COMMISSION ORDERS: 1. That the requested waiver of statutory notice in connection with the contract filed herein by American Water Resources, Inc., July 14, 1999, is hereby granted, and said contract shall become effective July 29, 1999. 2. This order shall in no way affect the authority of this Commission over rates, service, or accounts, evaluations, estimates, or determination of cost or any matters whatsoever that may come before it, nor shall anything herein be construed as an acquiescence in any estimate or determination of cost or any valuation of property claimed or asserted.
