FOR REISSUED TARIFF On April 6, 1999, Canterwood Water Company, Inc., (Canterwood) and Peninsula Light Company filed an application, in Docket UW-990568, for approval to transfer the assets of the Canterwood water system to Peninsula Light Company. Prior to this transfer application, Canterwood was regulated by the Washington Utilities and Transportation Commission (Commission) and served approximately 450 residential customers near Gig Harbor. Due to this transfer request, the Commission issued an order dated May 12, 1999, whereby Canterwood water system was transferred and deregulated, and its tariff was canceled. Subsequent to the Commission issued order, the final contract approvals were not obtained by Peninsula Light Company. The sale and transfer of the water system is now considered null and void. Canterwood remains jurisdictional and has filed to reissue its previously canceled tariff. The second revision of the tariff incorporates the first revision and no changes in rates, policies or practices have occurred. The application bears an effective date of August 1, 1999. This date recognizes statutory notice as required. The utility requests, however, that statutory notice be waived and that the tariff become effective July 1, 1999, on less than statutory notice (LSN). FINDINGS THE COMMISSION FINDS: 1. Canterwood Water Company, Inc., a Washington utility-, is a public service company subject to the jurisdiction of this Commission under the provisions of chapter 80 RCW. 2. As to form, the application herein, meets the require-ments of chapter 80 RCW and the rules and regulations of the Commission adopted pursuant thereto. 3. After careful examination of the filed tariff (WN-U2) herein by Canterwood Water Company, Inc., and giving consideration to all relevant matters and for good cause shown, the Commission finds that Canterwood Water Company, Inc., should be regulated and its filed, reissued, tariff should become effective July 1, 1999. O R D E R THE COMMISSION ORDERS: 1. That the requested waiver of statutory notice in connection with the application filed herein by Canterwood Water Company, Inc., June 25, 1999, is hereby granted, and said tariff shall become effective July 1, 1999. 2. After the effective date of this order and subject to the provisions hereof, Canterwood Water Company, Inc., is hereby autho-rized to operate under the terms and conditions of the reissued tariff (WN-U2) filed as an exhibit in the application herein. 3. That Canterwood Water Company, Inc., is subject to regulation by the Commission and its request to reissue its previously canceled tariff is hereby granted.
