On September 16, 1998, Comm South Companies, Inc. (Comm South), filed with the Commission an initial tariff filing in Docket UT-981205. The initial tariff filing is not in compliance with the requirements set forth in the Commission Order in Docket UT-980595 and WAC 480-121-040 and should therefore be rejected. The Commission in its Order in Docket UT-980595 in paragraph 4 stated: “Comm South Companies, Inc., shall collect advanced payments and deposits in compliance with WAC 480-121-040. Prior to supplying local exchange telecommunications services to the public, Comm South Companies, Inc., shall submit to the Commission an original satisfactory bond arrangement to protect customer monies.” Despite this requirement, Comm South has failed to file with the Commission an original satisfactory bond arrangement in compliance with WAC 480-121-040. Because, pursuant to the Commission Order in Docket UT-980595, Comm South’s commencement of service to the public is conditioned on it submitting a satisfactory bond arrangement, the instant tariff filing is unlawful, so it is appropriate that it be rejected. IT IS THEREFORE ORDERED That the above initial tariff filing of Comm South Companies, Inc., in Docket UT-981205, is rejected in its entirety.
