DOCKET UW-981096 Page 1 BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UW-981096 Connection with the Contract ) Filed by North Bainbridge ) ORDER GRANTING LESS Water Company, Inc. ) THAN STATUTORY NOTICE ) AND APPROVING CONTRACT On August 14, 1998, North Bainbridge Water Company, Inc., filed with the Commission a contract for water service with Olympic Terrace Water System Association, Inc. This contract provides for Olympic Terrace Water System Association, Inc. (Olympic Terrace Community), to install and pay for a 200-foot intertie line extension. This intertie line extension will be used for providing water service to the Olympic Terrace Community of twenty-four (24) existing services and two (2) ready-to-serve connections. This community will abandon their existing water system/source due to inability to maintain adequate capacity to serve its members and has elected to make application to North Bainbridge Water. Olympic Terrace Community owners will pay for the engineering and legal fees to provide the intertie line extension. Additionally, they will pay a $1,740 facilities charge each, $25.00 account set up fee each, and a $1,300 general administrative fee on a shared basis North Bainbridge will own and operate the intertie line extension, internal plat distribution system, and provide water services at its currently tariffed rates. The contract bears an effective date of September 13, 1998. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the contract become effective August 27, 1998, on less than statutory notice (LSN). The water company is requesting LSN treatment to meet the request of the Olympic Terrace Community owner’s urgent need for water service. Since the contract filed herein appears fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of August 27, 1998. FINDINGS After careful examination of the contract filed herein by North Bainbridge Water Company, Inc., August 14, 1998, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the contract should become effective August 27, 1998. O R D E R THE COMMISSION ORDERS: 1. That the requested waiver of statutory notice in connection with the contract filed herein by North Bainbridge Water Company, Inc., August 14, 1998, is hereby granted, and said contract shall become effective August 27, 1998. 2. North Bainbridge Water Company, Inc., shall within sixty (60) days of this approval file with the Commission a record of all cost incurred and bookkeeping entries reflecting this contract. 3. This order shall in no way affect the authority of this commission over rates, service, or accounts, evaluations, estimates, or determination of cost or any matters whatsoever that may come before it, nor shall anything herein be construed as an acquiescence in any estimate or determination of cost or any valuation of property claimed or asserted.
