On March 25, 1998, Washington Water Power Fiber, Inc., (WWP Fiber), filed an application request for registration to operate as a provider of intrastate telecommunications services. WWP Fiber proposes to offer telecommunications services through active fiber applications. The transport is through conduit and cable facilities in metropolitan Spokane and other areas of eastern Washington. WWP Fiber plans to accommodate requirements of the business community for transport of telecommunications. WWP Fiber primarily provides DS-1 service which supports voice, video, and data requirements and DS-3 service which supports voice, video, and data with multiplexing options at one or both ends to allow users to derive 1.544 Mbps DS-1 circuits. WWP Fiber also intends to provide telecommunications services between interexchange carriers’ points of presence and to connect end users to those points of presence, as well as provisioning of discrete networks. WWP Fiber may also offer services with greater capacity, higher speed transmission, protected service, and inactive (dark) fiber on an individual case basis. WWP Fiber is a wholly owned subsidiary of Avista Corporation and is headquartered in Spokane, Washington. Avista is a wholly owned subsidiary of Washington Water Power Company. WWP Fiber is a Washington corporation, incorporated on November 26, 1996, with a perpetual duration. The registered agent is TL Symms, Vice President and Corporate Secretary based in Spokane, Washington. Directors of the company are Chairman of the Board Lester Bryan, Vice President Jon Eliassen and Vice President Robert Fukai. WWP Fiber financial statements are reported on a consolidated basis with the financial statements of the Washington Water Power Company. WWP Fiber proposed tariff as amended is satisfactory. WWP Fiber has provided the information necessary to demonstrate that WWP Fiber possesses adequate financial resources and technical competence to provide the proposed services. WWP Fiber has voluntarily committed to collect and remit to appropriate administrative agencies relevant excise taxes in support of various social programs, including enhanced 911, telecommunications relay services, and lifeline. WWP Fiber does not propose to collect advanced payments or deposits from customers. FINDINGS THE COMMISSION FINDS: 1. WWP Fiber, Inc., is a public service company subject to the jurisdiction of this Commission under the provisions of chapter 80.36 RCW. 2. WWP Fiber, Inc., has provided sufficient information to show that it is financially and technically capable to provide the services proposed. 3. It appears, upon investigation, that the request for authority to register as a telecommunications company and provide telecommunications services should be approved. 4. In this proceeding, the Commission in no way endorses the financial viability of applicant nor the investment quality of any securities it may issue. O R D E R THE COMMISSION ORDERS: 1. After the effective date of this order and subject to the conditions hereof, the application of WWP Fiber, Inc., filed with the Commission requesting an order authorizing registration to provide telecommunications services is hereby granted. 2. This order shall in no way affect the authority of this Commission over rates, service, accounts, valuations, estimates or determination of costs, or any matters whatsoever that may come before it, nor shall anything herein be construed as an acquiescence in any estimate or determination of costs, or any valuation of property claimed or asserted. 3. The proposed tariff as filed and amended in Exhibit G, attached to the application, is satisfactory. Prior to supplying service to the public, WWP Fiber, Inc., shall file and receive permission and approval for an initial tariff identical to amended Exhibit G with the Commission. The tariff shall bear an effective date not less than 30 days subsequent to the date of receipt by the Commission. 4. Registration of WWP Fiber, Inc., as a telecommunications company shall not be construed as an endorsement of financial viability nor of the investment quality of any securities it may issue. 5. WWP Fiber, Inc., shall not collect advanced payments or deposits without first showing that it has a satisfactory arrangement to protect customer monies as stated in WAC 480-121-040.
