IN THE MATTER OF APPLICATION TO WAIVE STATUTORY REQUIREMENT for other than 
state tariff by:

Petitioner desires to change Tariff, Number 2.

Present provisions are: Supplement #3 providing for a 3.6% County Excise Tax on 
all regulated residential and commercial charges excluding drop box charges 
which are charged $6.50 per ton on pass-through tonnage.

Proposed changes are: Supplement #4 to provide for an increase in Whatcom 
County Excise Tax from 3.6% to 4.9% on regulated charges excluding drop box 
charges which will be $850 per ton tax on pass-through tonnage.

Reason petitioner requests waiver of statutory requirements and permission to 
file and publish the proposed provisions:

To comply with the Whatcom County Ordinance #97-52, collection of a solid waste 
excise tax increase, with the start date of April 1, 1998.
