DOCKET UE-980222 Page 1 BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UE-980222 Connection with the Tariff ) Revisions Filed by ) ORDER GRANTING LESS Pacific Power and Light Company ) THAN STATUTORY NOTICE ) On February 19, 1998, Pacific Power and Light Company (Pacific Power/Company) filed with the Commission under its Advice No. 98-003 revisions to its currently effective Tariff WN U-74, designated as Sixth Revision of Sheet No. 101.1, Schedule 101. The tariff sheet bears an inserted effective date of March 21, 1998. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the revisions become effective March 13, 1998. Pacific Power proposes to change the Town of Tieton tax rate to comply with Tieton Town Ordinance No. 423, enacted on January 13, 1998. The tax rate changes from 3 percent to 5 percent of charges per customer per month. The tax rate change would become effective March 13, 1998, in accordance with Section 35.21.865 of the Revised Code of Washington. Due to Ordinance No. 423 and its effective date of March 13, 1998, the Company respectfully requests waiver of the 30-day statutory notice period. Since the tariff revisions filed herein are fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of March 13, 1998. FINDINGS After careful examination of the tariff revisions filed herein by Pacific Power and Light Company, on February 19, 1998, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revisions should become effective March 13, 1998. O R D E R THE COMMISSION THEREFORE ORDERS That the requested waiver of statutory notice in connection with the tariff revisions filed herein by Pacific Power and Light Company, on February 19, 1998, is hereby granted, and said tariff revisions shall become effective March 13, 1998.
