DOCKET UR-971755 Page 1 BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UR-971755 Docket UR-971755 ) Connection with the Tariff ) Revision Filed by ) ORDER GRANTING LESS US Ecology, Inc. ) THAN STATUTORY NOTICE ) On December 11, 1997, US Ecology, Inc., filed with the Commission a revision to its currently effective Tariff One, Seventh Revision Schedule A, and Ninth Revision Schedule C. The tariff sheets bear an inserted effective date of January 9, 1998. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the revision become effective January 1, 1998. US Ecology filed tariff revisions which implement the Stipulation Regarding Rate Design and Ratemaking Issues, and the Settlement Agreement on Revenue Requirement Issues, as accepted by the Commission in Docket UR-950619 and UR-950620. Under the Settlement Agreement, the company is required to adjust its rates to become effective January 1 of each year. Because US Ecology did not receive generator projections in a timely manner US Ecology was not able to request tariff revisions by December 1, 1997. Since the tariff revision filed herein is fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of January 1, 1998. FINDINGS After careful examination of the tariff revision filed herein by US Ecology, Inc., December 11, 1997, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revision should become effective January 1, 1998. O R D E R THE COMMISSION THEREFORE ORDERS That the requested waiver of statutory notice in connection with the tariff revision filed herein by US Ecology, Inc., December 11, 1997, is hereby granted, and said tariff revision shall become effective January 1, 1998. DATED at Olympia, Washington, and effective this 31st day of December, 1997. WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION ANNE LEVINSON, Chair RICHARD HEMSTAD, Commissioner WILLIAM R.
