DOCKET UW-971597 Page 1 BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UW-971597 Connection with the Tariff ) Revisions Filed by ) ORDER GRANTING LESS Atlas Development Corporation ) THAN STATUTORY NOTICE dba Sunshine Acres Water System. ) ) On November 4, 1997, Atlas Development Corporation dba Sunshine Acres Water System filed with the Commission revisions to its currently effective Tariff WN U-1, designated as: Second Revision of Sheet No. 2 Canceling First Revision of Sheet No. 2; Third Revision of Sheet No. 21 Canceling Second Revision of Sheet No. 21; Third Revision of Sheet No. 22 Canceling Second Revision of Sheet No. 22; First Revision of Sheet No. 23 Canceling Original Sheet No. 23; Original Sheet No. 31; and Original Sheet No. 32. The tariff sheets bear an inserted effective date of December 4, 1997. This date recognizes statutory notice as required. The company requests, however, that statutory notice be waived and that the revisions become effective December 1, 1997. On November 4, 1997, Atlas Development Corporation dba Sunshine Acres Water and commonly known as Sunshine Acres, filed for general rates in the annual amount of $24,500 (31% annual increase). Atlas Development Corporation serves residential customers on two systems called Sunshine Acres (246) near Diamond Point and Lee Water (73) near Sequim in Clallum County. The company is requesting the increase in general rates to recover its increasing expenses of operating and maintaining the water systems. The company claims that these costs have increased dramatically since the last rate increase in 1989. These costs include preparation of a comprehensive water system plan, safe drinking water act updates for testing, and an ongoing increase in all-around costs. Sunshine Acres is requesting Less Than Statutory (LSN) notice treatment to coincide with the company's billing cycle. Since the tariff revisions filed herein are fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the company be granted the waiver it is requesting with an effective date of December 1, 1997. FINDINGS After careful examination of the tariff revisions filed herein by Atlas Development Corporation dba Sunshine Acres Water System, November 4, 1997, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revisions should become effective December 1, 1997. O R D E R THE COMMISSION THEREFORE ORDERS That the requested waiver of statutory notice in connection with the tariff revisions filed herein by Atlas Development Corporation dba Sunshine Acres Water System, November 4, 1997, is hereby granted, and said tariff revisions shall become effective December 1, 1997.
