DOCKET UT-970615 PAGE 1 BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Requested ) Waiver of Statutory Notice in ) DOCKET UT-970615 Connection with the Tariff ) Revision Filed by the Washington ) ORDER GRANTING LESS Exchange Carrier Association ) THAN STATUTORY NOTICE ) On April 7, 1997, the Washington Exchange Carrier Association (WECA), filed with the Commission under its Advice No. 16 a revision to its currently effective Tariff WN U-1, designated as Original Sheet No. 10 - Schedule 5. The tariff sheet bears an inserted effective date of May 8, 1997. This date recognizes statutory notice as required. WECA requests, however, that statutory notice be waived, and that the revision become effective April 24, 1997. The purpose of this filing is to provide a rate additive element in the WECA access tariff which will be remitted to Pend Oreille Telephone Company (POTC) to recover a short-fall in POTC's revenue requirement for access service. This rate additive will be used on an interim basis until such time as POTC is incorporated into the WECA carrier common line pool. WECA requests an effective date which is less than statutory notice in order to meet Commission Staff's requested effective date. Since the tariff revision filed herein is fair, just, and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that WECA be granted the waiver it is requesting with an effective date of April 24, 1997. FINDINGS After careful examination of the tariff revision filed herein by the Washington Exchange Carrier Association on April 7, 1997, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revision should become effective April 24, 1997. O R D E R THE COMMISSION ORDERS that the requested waiver of statutory notice in connection with the tariff revision in Advice No. 16 filed herein by the Washington Exchange Carrier Association on April 7, 1997, is granted, and said tariff revision shall become effective April 24, 1997.
