By petition filed July 15, 1997, NEXTLINK Washington ("NEXTLINK") seeks approval in Docket No. UT-970320 of its IntraLATA Presubscription Implementation Plan. The petition is filed pursuant to the Federal Communications Commission's Second Report and Order, implementation of the Local Competition Provisions of the Telecommunications Act of 1996, CC Docket No. 96-98, as implemented by state law under RCW 80.01.040(3). Pursuant to 47 C.F.R. section 51.213, all local exchange carriers are to implement toll dialing parity coincident with provision of in-region, interLATA or in-region, interstate toll services in the state, but not later than February 8, 1999. LECs, other than Bell Operation Companies, that either already offer or plan to begin to provide in-region, interLATA or in-region, interstate toll services before August 8, 1997, must implement toll dialing parity by August 8, 1997. The FCC requires that the implementation plan must be approved by the state commission. The plan must include a proposal that explains how the LEC will offer intraLATA toll dialing parity in the state and a proposal for timely notification of its subscribers and the methods it proposes to use to enable subscribers to select an intraLATA toll service provider. NEXTLINK proposes to implement a full 2-PIC method for intraLATA presubscription. A five dollar PIC change charge will be incurred and billed to the customer for each eligible line where a PIC change is made. In an effort to reduce unauthorized PIC changes, NEXTLINK will offer intraLATA PIC Freeze service to all customers at no charge. FINDINGS OF FACT AND CONCLUSIONS OF LAW After reviewing the petition and supporting materials submitted by the Petitioner, the Commission finds and concludes as follows: 1. The Commission has jurisdiction over this matter under RCW80.01.040(3) and 47 U.S.C. section 251 b(3). 2. The petition of NEXTLINK should be granted because it meets the requirement set forth in the FCC's Second Report and Order and complies with 47 C.F.R. sections 51.211 and 213. ORDER IT IS ORDERED That the petition by NEXTLINK Washington for approval of IntraLATA Presubscription Implementation Plan is granted.
