On May 23, 1996, Harold and Veree Parks, d/b/a Satellite Water Systems (Satellite)filed a joint application with Lewis County Utility Corporation (LCUC) for authority to transfer the following systems from Satellite to LCUC: Aust Water System Covington Water System Crowder Water System Deschutes Glen Water System Harmon Water System Ivan Street Acres Water System Jenni Water System Little Donkey Water System Marshall Water System Nisqually Water System Prairie Villa Water System Rich Road Water System Rixie Road Water System Sargent Road Water System Seed Water System Shadowood Water System Tall Timbers Water System Tilley Road Water System Tolmie Park Water System Valley Meadows Water System These water systems currently serve 273 customers in Thurston and Lewis counties. LCUC falls under the jurisdiction of the Washington Utilities and Transportation Commission with the approval of this transfer. An initial tariff was filed to recognize this. Satellite is currently regulated by the Washington Utilities and Transportation Commission. The terms and conditions of the transfer are set forth in an Agreement to Transfer these water systems filed with the Commission on May 23, 1996. Satellite will sell plant to LCUC for a mutually agreed amount of $74,300. Docket UW-960684 Page 1 FINDINGS THE COMMISSION FINDS: 1. Harold and Veree Parks d/b/a Satellite Water Systems, a Washington company, and Lewis County Utility Corporation, a Washington corporation, are public service companies subject to the jurisdiction of this Commission under the provisions of chapter 80.12 RCW. 2. As to form, the application herein, meets the require-ments of chapter 80.12 RCW and the rules and regulation of the Commis-sion adopted pursuant thereto. 3. It appears, upon investigation, that the Agreement to Transfer is reasonable and consistent with the public interest and should therefore be approved. O R D E R THE COMMISSION ORDERS: 1. Subject to the conditions of this order, Harold and Veree Parks d/b/a Satellite Water Systems, is hereby authorized to transfer water systems to Lewis County Utility Corporation, pursuant to the Agreement to Transfer filed with the Commission on May 23, 1996. 2. No material change, revision, or amendment to the agreement described in ordering paragraph no. 1 of this order shall become effective without the Commission's prior written approval. 3. Applicants shall file with the Commission, on or before the effective date of the transfer agreement, updates to the respective tariffs reflecting the changes in systems and adopting the rates of the transferring company to the accepting company to be used for the transfered water systems’ customers until such time as the Commission approves new rates for this system. 4. Applicants shall file with the Commission, within 30 days of final transfer of the transfered water systems, for its prior written approval, the journal entries by which they propose to record on their books the sale and transfer authorized herein. 5. This order shall in no way affect the authority of this Commission over rates, service, or accounts, evaluations, esti-mates, or determination of cost or any matters whatsoever that may come before it, including rates relating to the Docket UW-960684Page 1 agreement or payments of the elements which are the subject of this order, nor shall anything herein be construed as an acquiescence in any estimate or determination of cost or any valuation of property claimed or asserted.
