BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION WASHINGTON UTILITIES AND ) TRANSPORTATION COMMISSION ) DOCKET UW-950981 ) Complainant ) COMPLAINT AND ORDER vs. ) SUSPENDING ) TARIFF REVISIONS Frog Pond Waters, Inc. ) ) Respondent ) . . . . . . . . . . . . . ) On August 24, 1995, Frog Pond Waters, Inc., (Frog Pond) filed a general rate increase and a Safe Drinking Water Act (SDWA) Surcharge to become effective October 1, 1995. The combined impact of the two items would be an annual increase of $28,000. Frog Pond serves approximately 470 customers in the Seabeck area of Kitsap County. The company cites that the rate increase is necessary in order to cover added cost and comply with the SDWA. The filing requests that an inverted rate structure be applied for water consumption. The average monthly usage per customer is approximately 1,497 cubic feet. Currently the company does not have meters installed and all customer are billed at the flat rate. It appearing that the support documentation of the tariff revisions has not provided necessary information for Commission staff to determine if the rates are fair, just, reasonable, and sufficient, it is the decision of the Commission to enter upon public hearing or hearings concerning such proposed charges and the reasonableness and justness thereof and to suspend the operation of the above tariffs pending such hearing or hearings and decision thereon. In accordance with RCW 80.04.130 and because there is no specified tariffed rates, the burden of proof to show that such proposed charges are fair, just, reasonable, and sufficient shall be upon the respondent. IT IS THEREFORE ORDERED: 1. The operation of the above tariff revisions, filed herein on August 24, 1995, is hereby suspended. 2. A hearing or hearings, on the Commission's own motion, shall be held at such times and places as may be required. Docket: UW-950981 Page 1 3. No changes or alterations shall be made in the rate filing proposed herein, during the period of suspension, unless authorized by the Commission.
