BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of the Petition of: TOLEDO TELENET LONG DISTANCE COMPANY, COIN TELECOM, INC., PIONEER TELEPHONE LONG DISTANCE COMPANY, TENKAL COMPANY, INLAND LONG DISTANCE COMPANY, HOOD CANAL COMMUNICATIONS LONG DISTANCE, INC., and WESTERN LONG DISTANCE, INC., for a Limited Waiver of Administrative Rules. ....................................................................... ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) DOCKET UT-000372 DOCKET UT-000373 DOCKET UT-000374 DOCKET UT-000375 DOCKET UT-000376 DOCKET UT-000377 DOCKET UT-000378 ORDER GRANTING LIMITED WAIVER OF RULES On March 14, 2000, Toledo Telenet Long Distance Company, Coin Telecom, Inc., Pioneer Telephone Long Distance Company, Tenkal Company, Inland Long Distance Company, Hood Canal Communications Long Distance, Inc., and Western Long Distance, Inc., all affiliates of independent incumbent local exchange carriers, or ILECs, (collectively "ILEC Affiliates") filed petitions requesting limited waiver of WAC 480-120-139 for the initial transfer of intrastate intraLATA toll customers from U S WEST Communications, Inc., (U S WEST), to each of them, on March 31, 2000. The reason for this request is to allow the ILEC Affiliates to replace U S WEST as the intraLATA carrier of last resort, or default carrier, as U S WEST exits the intraLATA toll market in the respective ILEC service territories. Under WAC 480-120-139, "Changes in local exchange and intrastate toll services," the ILEC Affiliates would not be able to submit a change in a customer's intrastate toll service without confirming the customer's authorization in accordance with requirements in the rule. Because the current default carrier, U S WEST, is exiting the market, and customers need to have a carrier, this waiver would allow the ILEC Affiliates to be the new default carrier in the event that any customer fails to make a different selection for themselves. Customer notices have been reviewed and mailed to all affected customers informing them of their options, including this default mechanism. FINDINGS 1. Toledo Telenet Long Distance Company, Coin Telecom, Inc., Pioneer Telephone Long Distance Company, Tenkal Company, Inland Long Distance Company, Hood Canal Communications Long Distance, Inc, and Western Long Distance, Inc., are Washington corporations, and are public service companies subject to the jurisdiction of this Commission under the provisions of chapter 80.36 RCW. 2. The limited waiver of WAC 480-120-139 as described above, is reasonable and consistent with the public interest, and should therefore be approved. O R D E R THE COMMISSION ORDERS; After the effective date of this order, Toledo Telenet Long Distance Company, Coin Telecom, Inc., Pioneer Telephone Long Distance Company, Tenkal Company, Inland Long Distance Company, Hood Canal Communications Long Distance, Inc, and Western Long Distance, Inc., are hereby granted a limited waiver of WAC 480-120-139, for the initial transfer of intraLATA toll customers from U S WEST Communications, Inc., on March 30 and 31, 2000; and such transfer is hereby authorized.
