BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION In the Matter of Tariff Revisions and the Requested Waiver of Statutory Notice in Connection with the Tariff Revisions Filed by Harbor Springs Water Co., Inc. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) ) ) ) ) ) ) DOCKETS UW-991863, UW-000126 ORDER DISMISSING COMPLAINT AND ORDER SUSPENDING TARIFF REVISIONS IN DOCKET UW-991863 AND GRANTING LESS THAN STATUTORY NOTICE IN DOCKET UW-000126 BACKGROUND On November 30,1999, Harbor Springs Water Co., Inc. (Harbor Water) filed tariff revisions in docket UW-991863 with the Commission designated as: Second Revised Sheet No. 21 Canceling Original Sheet No. 21. On December 29, 1999, the Commission entered a Complaint and Order Suspending Tariff Revisions. The Commission is now in receipt of a letter dated February 1, 2000, whereby respondent requests that the tariff revisions filed in Docket UW-991863 be allowed to be withdrawn. It appears to be in the public interest to accommodate the request and to dismiss the Complaint and Order Suspending Tariff Revisions in Docket UW-991863. Concurrent with the withdrawal letter, the Company filed revised tariff sheets in Docket UW-000126. These revised sheets bear an inserted effective date of March 3, 2000. This date recognizes statutory notice as required. The Company requests, however, that statutory notice be waived and that the revisions become effective March 1, 2000, to coincide with the Company's next billing cycle. Since the revised tariff revisions filed in Docket UW-000126 appear to be fair, just and reasonable, and waiver of statutory notice is not inconsistent with the public interest, it is deemed appropriate that the Company be granted the waiver it is requesting with an effective date of March 1, 2000. FINDINGS After review of the tariff revisions filed in Docket UW-991863 by Harbor Springs Water Company, Inc., on February 1, 2000, and giving due consideration, the Commission finds that the Complaint and Order Suspending Tariff Revisions in Docket UW-991863, dated December 29, 1999, should be dismissed. After careful examination of the tariff revisions filed in Docket UW-000126 by Harbor Springs Water Company, Inc., on February 1, 2000, and giving consideration to all relevant matters and for good cause shown, the Commission finds that the tariff revisions should become effective March 1, 2000 O R D E R THE COMMISSION THEREFORE ORDERS: 1. The Complaint and Order Suspending Tariff Revisions in Docket UW-991863, dated December 29, 1999, be and the same is hereby dismissed. 2. That the requested waiver of statutory notice in connection with the tariff revisions filed in Docket UW-000126 by Harbor Springs Water Company, Inc., on February 1, 2000, is hereby granted, and said tariff revisions shall become effective March 1, 2000.
