TALL TIMBER WATER SYSTEMS, LLC Respondent. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) ) ) ) ) ) ) ) ) ) ) ) DOCKET UW-002051 ORDER DISMISSING COMPLAINT AND ORDER SUSPENDING TARIFF REVISIONS; GRANTING TARIFF REVISIONS AND REQUIRING REPORTING PER WAC 480-110-455(4) BACKGROUND 1 On December 22, 2000, Tall Timber Water Systems, LLC (Tall Timber Water) filed with the Commission revisions to its currently effective Tariff WN U-1, designated as Second Revision of Sheet No.2 Canceling First Revision Sheet No. 2, and Original Sheet No. 32. Third Revision Canceling Second Revision Sheet No. 21 and Third Revision Canceling Second Revision Sheet No. 22 was substituted. 2 On December 27, 2000, the Commission entered a Complaint and Order Suspending Tariff Revisions pending an investigation to determine whether the revisions are fair, just and reasonable. 3 Subsequent to the original filing in November of last year for a general company wide treatment surcharge, Commission Staff, Company and customers met several times and agreed on a ballot to determine the appropriateness of the treatment surcharge for Cedar Shores only. This ballot was to allow customers the opportunity to vote for the treatment system cost recovery or to have the treatment system removed. The voting process resulted in seventeen (17) votes approving the surcharge amount to pay for the treatment and three (3) votes opposed to paying the surcharge and agreeing to no water treatment. 4 The revised surcharge would be collected from Cedar Shores' customers only. The Total cost for iron/manganese treatment is $45,808. The monthly surcharge is based on current number of customers (36) and allows recovery over a 20-year period. This monthly surcharge includes principal, interest and state tax. New connections would pay a catch-up payment (based on time from surcharge starting to connection) and the monthly surcharge. New customer connections would reduce the life of the surcharge recovery period and the amount collected from each customer. Surcharge will expire in 20 years or sooner if the principal is repaid. A one-time payment of $1,273 may be made in the first 90 days of the collection period to avoid interest cost. FINDINGS 5 (1) Tall Timber Water is a water utility company and is a public service company subject to the jurisdiction of the Commission. 6 (2) It is consistent with the public interest to dismiss the Complaint and Order Suspending Tariff Revisions in this docket and to grant the revised tariff revisions to become effective on June 1, 2001. O R D E R THE COMMISSION ORDERS: 8 (1) The Commission dismisses the Complaint and Order Suspending Tariff Revisions in this docket, dated December 27, 2000. 9 (2) The revised tariff revisions filed in this docket, UW-002051, shall be effective on June 1, 2001. 10 (3) Tall Timber Water Systems, LLC is required to report quarterly per WAC 480-110-455 (4), within 45 days of the calendar quarter ending.
