BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION WASHINGTON UTILITIES AND ) TRANSPORTATION COMMISSION, ) ) Complainant, ) DOCKET TG-000051 ) vs. ) FIRST SUPPLEMENTAL ORDER ) DISMISSING COMPLAINT, DAHL-SMYTH, INC., G-165 ) LIFTING SUSPENSION AND ) APPROVING PERMANENT ) RATES Respondent. ) ) BACKGROUND On January 14, 2000, Dahl-Smyth, Inc., G-165, filed with the Washington Utilities and Transportation Commission, revisions to its current tariff naming rates to become effective March 1, 2000. The revisions consisted of increased rates due to an increase in disposal fees and other operating costs. At the Commission's Open Public Meeting on February 23, 2000, the Commission suspended the filing to allow for investigation to ensure the rights and interests of the public would not be injuriously affected. Temporary rates, per RCW 81.77.160, with rates not to exceed the disposal fee increase, were approved to become effective March 1, 2000. The Respondent has requested to withdraw its originally proposed tariff revisions, with the exception of 2nd Revised Page No. 8 which is revised to include language on the placement of containers and the 1st Revised Page No. 9 which is revised to include all major holidays. Neither of these pages effects the revenue requirement of the Respondent and Commission Staff recommended that the pages should be allowed to become effective as permanent pages. The Respondent also has requested that temporary rates filed per RCW 81.77.160 be made permanent. This matter was brought before the Commission at its regularly scheduled open meeting on November 29, 2000. The Commissioners, having been fully advised in the matter, and having determined the following order to be consistent with the public interest, directed the Secretary to enter the following order and related provisions. O R D E R IT IS ORDERED THAT: 1. The Complaint and Order issued February 23, 2000, suspending Docket TG-000051 is hereby dismissed. 2. The Respondent be allowed to withdraw its originally proposed revisions, except for the 2nd Revised Page No. 8 and 1st Revised Page No. 9 which shall be authorized to become effective December 1, 2000. 3. The present temporary rates shall be authorized to become effective December 1, 2000, on a permanent basis. DATED at Olympia, Washington, and effective this 29th day of November, 2000.
