BEFORE THE WASHINGTON UTILITIES AND TRANSPORTATION COMMISSION WASHINGTON UTILITIES AND ) TRANSPORTATION COMMISSION, ) DOCKET UW-000126 ) Complainant, ) ORDER DISMISSING ) COMPLAINT AND ORDER vs. ) SUSPENDING TARIFF ) REVISION AND ALLOWING HARBOR SPRINGS WATER CO., INC. ) TARIFFS TO BECOME ) EFFECTIVE, MAY 1, 2000 AND ) APPROVING STIPULATION Respondent. ) ) On February 1, 2000, Harbor Springs Water Co., Inc. filed tariff revision in UW-000126, a revision to its currently effective Tariff WN U-1 designated as: First Revised Sheet No. 21 Canceling Original Sheet No. 21 It appearing that the filing herein would increase rates for water service rendered by respondent and that the rights and interest of the public might be injuriously affected thereby, the Commission entered a Complaint and Order Suspending Tariff Revision on February 23, 2000. The Commission is now in receipt of a signed stipulation agreement dated April 10, 2000, whereby respondent has agreed to complete specified projects within the specified time. The stipulation is attached as exhibit A to this order. From all indications, it appears to be in the public interest to accommodate the request and to concurrently dismiss the Complaint and Order Suspending Tariff Revision and allow the proposed tariff revision and approve the stipulation. F I N D I N G S 1. Harbor Springs Water Co., Inc. is an investor owned water company and as such is a public service company subject to the jurisdiction of the Commission. 2. The tariff revision presently under suspension herein is considered to be reasonable. 3. The stipulation which is attached to this order is consistent with the public interest and its terms are just, fair, and reasonable. 4. It is not contrary to the public interest that the Complaint and Order Suspending Tariff Revision in this docket be dismissed and that the tariff revision become effective May 1, 2000. O R D E R THE COMMISSION THEREFORE ORDERS that the Complaint and Order Suspending Tariff Revision in Docket UW-000126 dated February 23, 2000 is hereby dismissed, and that the tariff revision filed herein on February 1, 2000, shall become effective May 1, 2000, and that the stipulation attached hereto is approved.
