UT-991627 CONERVATION ) OF NUMBERING RESOURCES ) ORDER RECLAIMING . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ) NUMBERING RESOURCES Background On July 20, 2000, the Federal Communications Commission (FCC) granted to the Washington Utilities and Transportation Commission (WUTC or Commission) the authority to implement number conservation measures, including reclamation of Numbering Resources. Code Holders are granted six months to activate Numbering Resources, otherwise the Commission may order reclamation. In addition, the Commission may grant a single extension of the reservation, of six months, in cases where the code holder is able to demonstrate that the proposed use date was missed due to circumstances beyond its control. In re Numbering Resource Optimization Implementation of Local Competition Provisions of Telecommunications Act of 1996, Order, CC Docket No. 99-200 and CC Docket No. 96-98, 2000 WL 991629, ¶ 52 (rel. July 20, 2000). The North American Numbering Plan Administrator on January 8, 2001 notified the WUTC of 46 telephone prefixes in Washington State for which service providers had not provided certification that the prefixes were in service and being used to serve end users. Staff notified each code holder by letter on January 11, 2001 that the codes were delinquent and that the WUTC intended to direct NANPA to reclaim them. Service providers were provided with an opportunity to demonstrate, by February 14, 2001, that any prefix should not be reclaimed. The WUTC received documentation from some service providers that prefixes had been put in service to end use customers or that good cause exists to grant an extension of the deadline. In other cases, service providers did not respond to the WUTC notice. The specific responses for each telephone number prefix are set out in Attachment A to this order. CONCLUSIONS OF LAW 1) The Commission has jurisdiction over this matter pursuant to RCW 80.36.610, which gives the Commission authority to take actions necessary to implement the Federal Telecommunications Act of 1996. ORDER 1) The Commission orders that delinquent Numbering Resources be reclaimed, as indicated on the attached summary; those so noted should be granted extensions until the date specified, and Part IVs accepted as noted, for those codes already in service. 2) The Commission retains jurisdiction over this matter to issue such future orders and take such future actions as may be appropriate.
