UT-990107 ) vs. ) ) COMPLAINT AND ORDER MCDANIEL TELEPHONE COMPANY, ) SUSPENDING TARIFF d/b/a TDS TELECOM ) REVISIONS AND INSTITUTING ) INVESTIGATION Respondent. ) ) On January 28, 1999, McDaniel Telephone Co., d/b/a TDS TELECOM (McDaniel) filed a tariff revision with the Commission designated as: Schedule 1, Second Revised Sheet No. 60. The tariff revision will add extended area service (EAS) to be the basic local calling capability of residential and business customers between the Onalaska, Mossyrock, Salkum exchanges of McDaniel and the Centralia and Chehalis of U S WEST Communications, Inc. This tariff revision provides for McDaniel to establish an EAS additive charge of $6.60 per line per month to be added to the Residential Exchange Access Line and Business Exchange Access Line rates. At the Commission's regularly scheduled open public meeting on February 26, 1999, Commission Staff and the Company agreed to recommend to the Commission that the EAS routes and rates become effective February 27, 1999, as filed, subject to refund or credit. Pursuant to full review and consideration of the filing, the recommendation of Commission Staff and the Company, the Commission finds that the rates, subject to refund and/or credit, be allowed. It appears that the proposed rates would result in charges and rates for telecommunications service furnished by McDaniel, and that the rights and interests of the public might be injuriously affected. Therefore, it is the decision of the Commission to enter upon public hearing(s) concerning such charges and the reasonableness and justness of same, and to suspend the operation of the above filing pending such hearing(s) and the ultimate decision of the Commission. The Commission deems it necessary in order to carry out the duties imposed upon it by law to investigate the books, accounts, practices and activities of respondent, to make a valuation or appraisal of the property of respondent and to investigate and appraise various phases of the operation of respondent. ORDER THE COMMISSION ORDERS: 1. The operation of the January 28, 1999 tariff filing of McDaniel is suspended. 2. A hearing on the Commission's own motion shall be held at such times and places as may be required, subsequent to written notice. 3. Pending hearing in this matter, the rates as filed by McDaniel shall go into effect February 27, 1999, subject to refund or credit, as ordered by the Commission. 3. No change or alteration shall be made in the tariff filed in this matter during the period of suspension, unless authorized by Commission Order. 4. An investigation of the subject tariff filing is instituted by the Commission. 5. Respondent shall pay the expenses reasonably attributable and allocable to such investigation to the extent the requirement for such payment may be in accordance with the provisions of chapter 80.20 RCW.
